7月3日，杭州市上城区人民法院就全国首例恶意差评师案作出一审判决，以被告杨某为首的12名"恶意差评师"被以敲诈勒索罪判刑。此案在去年11月经杭州市公安局和淘宝网联合侦破；今年6月21日，法院正式开庭审理此案。他们的做法是选择单价不高的东西一起去下单，然后由杨某出面谈判。他们的敲诈金额不高，开价在两三百元。发货就给差评，不发货就投诉。通常赃款由杨某收取，向参与恶意下单的网络差评师分赃。12人共计非法所得2900余元。杨某起主要作用，系主犯。经法院判决，被告人杨某犯敲诈勒索罪，判处有期徒刑二年，并处罚金人民币5000元。11名从犯分别被判处有期徒刑一年二个月、一年及十个月，并分别处罚人民币2000元。根据最高法院的司法解释，"数额较大"的敲诈罪以一千元至三千元为起点。This entry passed through the Full-Text RSS service — if this is your content and you're reading it on someone else's site, please read the FAQ at fivefilters.org/content-only/faq.php#publishers.
