[unable to retrieve full-text content]一位美国联邦法官裁决转售数字MP3文件是不合法的，涉嫌侵犯版权。本案被告是二手数字音乐销售平台ReDigi，该平台允许用户转售合法从iTunes中购买的MP3。法官认为，转售法（first-sale doctrine）不适用于数字商品，理由是数字版权音乐作品通过互联网的转让具化为一个新的实物必然会涉及到版权法中的"复制权"，法庭判定在新硬盘中一个新实物的具化属于版权法的复制范畴。法官认为ReDigi无法用合理使用为其辩护。
